1. Acceptance of Terms
By creating an account or using TrademarkScout ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
TrademarkScout provides automated trademark infringement monitoring across e-commerce and advertising platforms. Scan results are informational only and do not constitute legal advice. We do not guarantee detection of all infringement.
3. Accounts
You must provide accurate information when creating your account. You are responsible for maintaining the security of your login credentials. You must be at least 18 years old and have the authority to bind a business if registering on its behalf.
4. Subscriptions and Billing
- Subscriptions are billed monthly in advance via Stripe.
- You may cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds are issued at our discretion within 30 days of initial purchase if the Service did not function as described.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
5. Free Trial
New accounts receive a 14-day free trial. No credit card is required during the trial. After the trial ends, access requires a paid subscription.
6. Acceptable Use
You agree not to:
- Use the Service to monitor trademarks you do not own or have authorization to protect.
- Submit false or misleading trademark information.
- Attempt to reverse-engineer, scrape, or disrupt the Service.
- Use scan results to harass, threaten, or make false claims against third parties.
- Resell or sublicense access to the Service without written permission.
7. Intellectual Property
TrademarkScout and its content, features, and functionality are owned by us and protected by copyright and trademark law. You retain ownership of the trademark data you submit. By submitting it, you grant us a license to use it solely to provide the Service.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not warrant that scans will be complete, accurate, or error-free. Scan results are not legal advice. Consult a qualified IP attorney before taking enforcement action.
9. Limitation of Liability
To the maximum extent permitted by law, TrademarkScout shall not be liable for indirect, incidental, special, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold TrademarkScout harmless from claims arising out of your use of the Service, your trademark data, or your violation of these Terms.
11. Termination
We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 7 days' notice. You may terminate at any time by cancelling your subscription and deleting your account.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved in the courts of Delaware.
13. Changes to Terms
We may update these Terms. We will notify you of material changes via email at least 14 days before they take effect. Continued use constitutes acceptance.
